COMPANY POLICY

ORDERS FOR UPHOLSTERY AND CASEGOODS

Catalogs and wholesale price lists are reserved for wholesale clients with sales tax exempt numbers.

No changes or cancellations are accepted after shipment. A 50% restocking fee will apply to changes or cancellations of casegoods order after staging for pickup. For upholstery, cancellations are not allowed or credited after the order has been specified and deposit paid.

TERMS OF PAYMENT

All prices are FOB Portland, IN. 50% prepayment by cash, check or credit card is required, with the balance due prior to shipment.

Orders will not be processed until the down payment is made, and in the case of upholstery orders cannot be processed until Design Specification Sheets and COM forms, if applicable, have been signed-off by the client.

Deposits paid by credit card will be charged to the customer's account at the time the order is received by TLS by Design. The balance due will automatically be charged to the same credit card before the order is shipped. If you want to use a different method of final payment, please let us know as soon as possible. Please allow for checks to clear prior production.

CUSTOM UPHOLSTERY ORDERS

TLS by Design does not assume responsibility for lost fabric and does not offer any warranty explicit or implied for customer's own material, customers own material (there is no fabric warranty with COM orders). COM orders may not be cancelled once the fabric has been cut.

CUSTOM CASEGOODS ORDERS

A 100% deposit is required for orders involving custom work. No Returns, refunds or credits accepted on custom work.

CONTAINER CASEGOODS ORDERS

Container programs are available. Please ask for details.

FREIGHT

Shipments are delivered freight collect or after shipping has been prepaid with the final balance due prior to leaving our dock. Items may be picked-up at our warehouse on the basis of scheduled appoints. Customers who refuse to accept delivery of an order without written proof of cancellation prior to shipping will be held responsible for the two-way freight charges and are subject to a 50% restocking fee.

DAMAGE

It is the responsibility of the customer to count and thoroughly inspect all shipments immediately upon arrival. It is the customer's responsibility to handle any claims of damage or missing items directly with the carrier. If exterior damage to the carton is visible, make a notation on the shipper's delivery ticket and notify the carrier at once. All damaged cartons should be saved until the claim is settled.

TLS by Design needs to be notified within 3 business days of any damages or shortages. Although TLS by Design can accept no responsibility for shipping damage, we will do our best to assist in settling claims that may arise with the carrier.

RETURNS

All return requests must be submitted in writing within 5 business days of delivery and be factory authorized. All returns are subject to a 15% restocking fee, plus two-way freight charges. No returns on custom orders. No returned items showing dealer's tags or showroom display wear and tear will be accepted.

PRODUCTS

Our products are hand crafted by skilled artisans. Slight variations in dimensions, detail and construction may occur. For example, it is normal and usual for upholstery dimensions to vary plus or minus .75" in any dimension given the use of foam, padding and the effect of crowning of cushions.

LIMITED LIFETIME WARRANTY ON UPHOLSTERY

TLS by Design offers a limited lifetime warranty on frame and spring construction against defective materials or workmanship and on seat cushions against the loss of resiliency. However, softening/flattening will occur in all foam as a result of use and age, but this is considered completely normal, given the quality of our high resilience cushions. We are unable to accept responsibility for wear, fading, or shrinkage.

TLS by Design will replace or repair, at our option, any part or parts of the warranted product found to be defective within terms of the warranty. In order for these repairs to be made without charge for materials, labor, or transportation between an authorized dealer and our factory, you must send a notice of the defect within one year from the date of retail delivery of your furniture. After one year, TLS by Design will not be liable for transportation and handling between the factory and the authorized dealer.

WARRANTY ON CASEGOODS

TLS by Design will warrant any defects due to defective materials or workmanship for a period of one year. TLS by Design will replace or repair, at our option, any part or parts of the warranted product found to be defective within terms of the warranty.
